These Terms of Service ("Terms") govern your use of AccessScan ("Service"), operated by AccessScan ("we", "us", "our"). By using the Service, you agree to these Terms.

1. Service Description

AccessScan provides automated website accessibility scanning and AI-powered remediation reports. Our Service scans publicly accessible web pages against WCAG 2.1 Level AA standards using the axe-core accessibility engine.

2. Important Disclaimers

Not legal advice. Our reports are technical assessments only. They do not constitute legal advice, certification, or a guarantee of compliance with the Americans with Disabilities Act (ADA), Section 508, or any other law or regulation. You should consult a qualified legal professional for compliance requirements specific to your situation.

Automated scanning limitations. Automated tools can detect many but not all accessibility issues. Our scans may not identify issues that require manual testing, such as the quality of alternative text, logical reading order, or the usability of complex interactive components. A passing score does not mean your website is fully accessible.

AI-generated suggestions. Fix suggestions in our reports are generated using artificial intelligence. While we strive for accuracy, these suggestions should be reviewed by a qualified web developer before implementation. We are not responsible for issues arising from implementing AI-generated suggestions.

3. Permitted Use

You may use the Service to:

• Scan websites that you own or have authorization to scan
• Generate accessibility reports for your own use or for your organization
• Share reports with your web development team or vendors

You may not:

• Scan websites you do not own or have permission to scan for the purpose of harassment, litigation, or competitive intelligence
• Resell reports as your own service without attribution
• Attempt to reverse-engineer, overload, or abuse the Service
• Use the Service for any unlawful purpose

4. Payments and Refunds

Paid reports are one-time purchases processed through Stripe. Prices are displayed at the time of purchase and are in USD.

Refund policy: If we fail to deliver your report within 24 hours of purchase, you are entitled to a full refund. Contact us at support@doaccessscan.com. Refunds are not available for successfully delivered reports, as the service is consumed upon delivery.

5. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL ACCESSSCAN BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

6. Intellectual Property

You retain ownership of your website content. Reports generated by the Service are licensed to you for your use. The Service itself, including its design, code, and AI models, remains our intellectual property.

7. Privacy

Your use of the Service is also governed by our Privacy Policy.

8. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by updating the date at the top of this page. Continued use of the Service after changes constitutes acceptance.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law provisions.
